Mirzaam App Terms and Conditions

The Mirzaam application (the “App”) is operated by شركة فوز اكسبوز لتنظيم المعارض والمؤتمرات والمعسكرات, a single person company registered in Kuwait under Commercial Registration No. 449618 and Commercial Licence No. 2021/17528 (the “Company”, “we” or “us”), referred to in English in this document as Fouz Expos Company. The Company owns the Mirzaam trademark.

These Terms govern access to exhibition information, voting, photo storage and prize draws when lawfully made available. Service specific rules are presented before participation and apply to that service, without limiting applicable law or statutory user rights.

These Terms and the Privacy Policy are available before account creation, and acceptance of the Terms is requested through a clear affirmative action. Users must be at least 18. Reaching that age does not establish full civil capacity for every transaction. Services creating legal or financial obligations require the capacity prescribed by Kuwaiti law and, where legally required, consent from a guardian or legal representative before access to that service. Draw participation and prize collection are also subject to the applicable draw rules and licence.

Some services require an account and phone verification through a one time password (OTP). Phone verification alone does not verify identity or age. Users must provide accurate, updated details, use a number they are entitled to use, protect verification codes, and promptly report unauthorised access. Responsibility is determined by the circumstances and applicable law; users are not automatically responsible for security failures attributable to the Company.

Users receive a personal, limited, non exclusive right to use the App for its intended purposes. Misleading information or documents, manipulation of services, multiple accounts or automated tools used to bypass participation limits, unauthorised system or account access, disruption, and unlawful content or content infringing others’ rights or privacy are prohibited.

Each user may cast one vote in each of the three announced categories. Voting dates, counting methods and additional rules are disclosed before participation. Votes may be excluded on reasonable grounds indicating manipulation or a breach, with a review request channel available. Counting rules will not be changed retrospectively to participants’ detriment except to meet a legal requirement or address a material defect, with the action and its effects explained.

Participation is enabled only after obtaining the required licence and approvals and confirming that they cover the participation and draw methods used. Separate rules must identify the organiser and licence, eligibility and qualifying purchases and evidence, dates, entry limits, prize details, selection, verification, notification and delivery, exclusions, complaints, and approved postponement or cancellation provisions. Entry does not guarantee a prize. No undisclosed prize claim fees may be imposed, and changes must not breach the licence or impair accrued rights.

Only necessary information is collected, including a phone number, email and civil ID where justified. Before an entry is submitted, the purpose, recipient, retention period and legal authority for disclosure or required consent are explained. Reference to the Ministry of Commerce and Industry or another authority in these Terms does not itself authorise disclosure; sharing must match the approved procedure and legal requirements.

The Company takes reasonable care to keep information accurate and current and announces material changes. Listing an exhibitor or product does not guarantee every claim made about it. Purchases from exhibitors are governed by the sale terms and applicable law, without excluding the Company’s own obligations, responsibility for transactions to which it is a party, or consumer rights.

Users retain their content rights and must hold the necessary permissions and respect the privacy of people depicted. Users grant the Company a non exclusive, royalty free licence to host, store, process and display content only as needed for the requested feature. Uploading for storage does not consent to public posting or advertising. Optional sharing must explain visibility beforehand. Advertising use requires separate, specific permission. Infringing content may be removed, with notice where possible. The licence ends upon deletion, except for limited processing needed to remove backups or comply with legal retention under the Privacy Policy.

The Company owns the Mirzaam trademark. App use grants no ownership or right to commercially use, imitate or use a confusingly similar mark, except with prior written permission or as permitted by law. Software, design and content rights belong to the Company or its licensors, as applicable, excluding user and third party content. Exploitation, copying or distribution requires permission or legal authority.

The Privacy Policy explains data handling and user rights. Acceptance of these Terms is not blanket consent to every use or disclosure. Required consents must be clear and specific, and marketing consent is optional and separate.

The Company takes reasonable care to operate and protect the App and address interruptions and their effects. Maintenance, faults or circumstances outside its control may affect availability, with advance notice of material maintenance where possible. Liability is determined under Kuwaiti law. These Terms do not exclude legal obligations or diminish consumer rights, including compensation where legally due.

Accounts may be restricted on reasonable grounds concerning breach, manipulation, security or a legal obligation. Action must be proportionate, with reasons and a review channel notified unless prohibited by law or prejudicial to security or a lawful investigation. Users may request closure and data deletion without forfeiting an established prize entitlement or claim. Amendments are published with their effective date; material changes are notified a reasonable time in advance where possible, and renewed acceptance is requested where required. Changes must not retrospectively impair accrued rights or existing participation terms contrary to law or the licence.

Kuwaiti law governs these Terms, and disputes fall within the jurisdiction of the competent Kuwaiti courts. Complaints may be sent to the Company without making this a prerequisite to contacting authorities or courts. Invalidity of one provision does not invalidate the remainder to the extent permitted by law. If the Arabic and English interpretations differ, the Arabic text prevails, subject to mandatory law.
